The traditional characterization of Charles Darwin as a strong advocate of physiological experimentation on animals was posited in Richard French’s Antivivisection and medical science in Victorian England, where French portrayed him as a soldier in Thomas Huxley’s efforts to preserve anatomical experimentation on animals unfettered by government regulation. That interpretation relied too much on, inter alia, Huxley’s own description of the legislative battles of 1875, and shared many historians’ propensity to foster a legacy of Darwin as a leader among (...) a new wave of scientists, even where personal interests might indicate a conflicting story. Animal rights issues concerned more than mere science for Darwin, however, and where debates over other scientific issues failed to inspire Darwin to become publicly active, he readily joined the battle over vivisection, helping to draft legislation which, in many ways, was more protective of animal rights than even the bills proposed by his friend and anti-vivisectionist, Frances Power Cobbe. Darwin may not have officially joined Cobbe’s side in the fight, but personal correspondence of the period between 1870 and 1875 reveals a man whose first interest was to protect animals from inhumane treatment, and second to protect the reputations of those men and physiologists who were his friends, and who he believed incapable of inhumane acts. On this latter point he and Cobbe never did reach agreement, but they certainly agreed on the humane treatment of animals, and the need to proscribe various forms of animal experimentation. (shrink)

The critical legal studies movement involves a group of scholars who have political views ranging from disaffected liberalism to committed marxism to utopian anarchism. This movement in the field of jurisprudence has arisen aver the past ten years and hopes to influence a radical change in what they view as liberal orthodox legal theory. Topics of discussion include the intellectual foundations of the CLS movement, its principles and aims, its critique of the legal doctrine and ideas for change.

The relationship between democracy and constitutions is a long and fractious one. Those who lean towards the constitutionalist side have tended to perceive democracy as a threat to political order and the preservation of important values, whereas those who take a more democratist stance tend to treat constitutions as elite hindrances to popular rule as much as anything else. In this paper, we will give the constitutionalist thesis a broader theoretical and political scrutiny. By way of explanation, we will address (...) and recommend the possibilities and problems for putting into practical operation such an anti-constitutionalist stance; the recent experience of the U.S. State of California offers itself as a good forcing-ground for these ideas. In short, from a democratic standpoint, the challenge for the citizenry is not so much about defining the values of constitutions, but constitutions whose change is outside the scope of popular decision making, supposed to exclusively take place through judicial interpretation or through an amendment formula designed precisely to make change difficult and unlikely. Too often, constitutions place checks and limits on democratic participation in the name of some other set of vaunted truths or elite-favouring values. For the strong democrat, it is formal constitutions and their institutional paraphernalia that do more to inhibit and dull democracy's emancipatory potential than to nurture and fulfil it. (shrink)

This book offers a radical challenge to accounts of the common law's development. Contrary to received jurisprudential wisdom, it maintains there is no grand theory which will explain satisfactorily the dynamic interactions of change and stability in the common law's history. Offering original readings of Charles Darwin's and Hans-Georg Gadamer's works, the book shows that law is a rhetorical activity that can only be properly appreciated in its historical and political context; tradition and transformation are locked in a mutually reinforcing (...) but thoroughly contingent embrace. In contrast to the dewy-eyed offerings of much contemporary work, it demonstrates that, like life, law is an organic process rather than a miraculous one. More has been said about the Hart-Fuller debate than can be considered healthy or productive even within the precious world of jurisprudential scholarship – too much philosophising about how law has revelled in its own abstractness and narrowness. But the mission of this book is distinctly and determinedly different – it is not to rework these already-rehashed ideas, but to reject them entirely. Rather than add to the massive jurisprudential literature that has been generated by all and sundry, the book (...) criticises and abandons the project that Hart and Fuller set in motion. It contends that the turn that was taken in 1957 has led down a series of cul-de-sacs, blind alleys, and dead-ends to nowhere useful or illuminating. It is more than past time to leave their debate behind and strike out in an entirely new and more promising direction. The book insists that not only law, but also all theorising about law, is political in all its derivations, dimensions, and directions. (shrink)

Not surprisingly, the debate about what makes a 'great judge' is as heated and inconclusive as the debate about the purpose and nature of law itself. History shows that those who are candidates for a judicial hall of fame are game changers who oblige us to rethink what it (...) is to be a good judge. So the best of judges must tread a thin line between modesty and hubris; they must be neither mere umpires nor demigods. The eight judges showcased in this book demonstrate that, if the test of good judging is not about getting it right, but doing it well, then the measure of great judging is about setting new standards for what counts as judging well. Toward an Informal Account of Legal Interpretation offers a viable account of law, judicial decision-making, and legal interpretation that is as fresh as it is familiar. The author expertly challenges the dominant mode of formalist theorizing and proposes an explanatory account of legal interpretation that can profitably be understood as an 'informal' intervention. Such an informal approach has no truck with either the claims of the formalists or those of the anti-formalists. Hutchinson insists that, when understood properly, legal interpretation is (...) an applied exercise in law-and-ideology; it is both constrained and unconstrained in equal measure. In developing this informalist account through a sustained application of the 'no vehicles in the park' rule, this book is wide-ranging in theoretical scope and substance, but also accessible and practical in style. The recent publication of a lost essay by Herbert Hart is important for an historical appreciation of his work, but its likely celebration is a sad testament to the poverty and lethargy of contemporary legal thought. I use this occasion to review the state and condition of contemporary legal theorising. After positioning Hart's essay in the prevailing jurisprudential milieu, I highlight the thrust and the failings of the three main traditional approaches to contemporary legal theorising in regard to the nature (...) and operation of 'judicial discretion'. As their title suggests, "legal philosophers" are more philosophers than lawyers; they are in the business of thinking generally about law rather than doing law in any practical way. While lawyers tend to be jurisdiction-specific in their affiliations and competence, legal philosophers are under no such restriction. At their most ambitious, legal philosophers claim dominion over a jurisprudential realm that is delineated by neither geography nor history. Indeed, presenting themselves as intellectual citizens of the whole legal world, their crafted contributions (...) are not intended to be judged by the contingent standards of local usefulness, but by the pure canons of universal validity. As such, the professional commitment and authority of legal philosophers is based upon their capacity to deal with parochial matters of law, but in a way that rises above and is not reducible to their local circumstances. Accordingly, while these legal philosophers might talk about morality and politics as they relate to law, they do so only in the most theoretical and abstract terms. For them, philosophy inhabits the realm of "truth and necessity" in which the contingent and the local holds little or no analytical sway. The contemporary champion of legal philosophy is undoubtedly Joseph Raz. His extensive and sophisticated work represents the high-water mark of analytical jurisprudence. With the recent publication of Between Authority and Interpretation, he has provided an accessible and stylish showcase of his philosophical theory of law that is as rigorous and demanding as it is provocative and controversial. Because this book builds on as it clarifies and develops the main themes of his work over the past four decades, it offers itself as a convenient focus for a more general assessment of Raz's whole oeuvre. In traversing law's terrain, he is adamant that, whatever the purposes and methods of other disciplines (e.g., sociology, history, anthropology, etc.), any philosophical analysis worth its name must concern itself with delivering insights and understanding about law that are of universal significance. While general conclusions about local laws and systems are important and helpful, they will have no philosophical value unless they can say something general and enduring about law as an institutional phenomenon. A corollary of this is that legal philosophy must insulate itself from contingent moral and political influences that will compromise or contaminate its project of making statements about law?s nature and operation that are not only universally valid, but also locally accurate. In this essay I challenge Raz's philosophical ambitions - and, therefore, much contemporary work in legal philosophy - by concentrating on his crucial methodological distinction between the local and contingent and the universal and necessary. It is my contention that, as there are no places where "moral and political desirability" do not play a role, "necessity" has no reign. Accordingly, I argue that legal philosophy cannot live up to its own methodological expectations and standards of validation. For all its impressive erudition and sophistication, therefore, Raz?s work is a manifesto of "local enthusiasms" that, while instructive and useful in themselves, can lay no claim to reveal the necessary features of law's existence. His work comprises some very contingent and localised generalisations that no amount of philosophical razzle-dazzle can elevate to universal and global truths about law. Blinded by the philosophical light, there is more formal brilliance than substantive bottom-line to Raz's jurisprudence. (shrink)

This paper sets out to assess the internal coherence of Roy Bhaskar's transcendental realist account of science. Whilst fully supporting his transcendental derivation of a stratified ontology of structures and generative mechanisms from the scientific practice of experimentation, I argue that Bhaskar's adoption of the stance of epistemic relativism results in his inability to defend the generalizability of this ontology. My argument against his epistemic stance turns on the fact that it rests on a false dichotomy between epistemic relativism and (...) epistemic absolutism, and, moreover, that it is quite unnecessary for his efforts to avoid the excesses of epistemological foundationalism. The net result of this stance, in my view, is an inability to sustain the normative force of the concepts of truth and scientific explanation precisely at a time when postmodern authors are denying their privileged status. In the Paralogisms of The Critique of Pure Reason, Kant comes to terms with this dialectic and with the character of the experiencing self. In this study, Powell seeks to elucidate these difficult texts, showing that the structure of the Paralogisms provides an essential key to understanding both Kant's critique of "rational psychology" and his theory of (...) self-consciousness. As Kant realized, the ways in which we must represent ourselves to ourselves have import not only for epistemology, but for our view of persons and of our own immortality, as well as for moral philosophy. PfizenmaierHistorians of Newton's thought have been wide ranging in their assessment of his conception of the trinity. David Brewster, in his The Life of Sir Isaac Newton (1831), was fully convinced that Newton was an orthodox trinitarian, although he recognized that "a traditionary belief has long prevailed that Newton was an Arian."1 Two reasons were used to defend his conclusion that Newton (...) was orthodox. The first was a letter from John Craig, a friend of Newton, written shortly after Newton's death to John Conduitt, the husband of Newton's niece. In this letter Craig remarked that Newton's theological opinions "were sometimes different from those which are commonly received" but that he hoped Conduitt would publish Newton's theological papers, "that the world may see that Sir Isaac Newton was as good a Christian as he was a mathematician and philosopher."2 The second reason with which Brewster defended his conclusion was his acknowledgment that the doctrine of the trinity itself had variations.I had no hesitation when writing the Life of Sir Isaac Newton in 1830, in coming to the conclusion that he was a believer in the Trinity; and in giving this opinion on the creed of so great a man, and so indefatigable a student of scripture, I was well aware that there are various forms of Trinitarian truth, and various modes of expressing it, which have been received as orthodox in the purest societies of the Christian Church.3L. T. More in his biography Isaac Newton gently chided Brewster for not publishing some of the crucial manuscripts, which eventually became [End Page 57] part of the Keynes collection.4 From these additional manuscripts More reached the conclusion that Newton was not orthodox but an Arian. He proceeded to say that Newton was not only an Arian but, because of the manner in which he understood Jesus' role as prophet, a Unitarian.5More recently the famous British economist John M. Keynes, who considered it a great "impiety" that the Portsmouth family's collection of Newton's non-scientific manuscripts were dispersed at the Sotheby's auction in 1936 and who recovered about half of them creating the "Keynes" collection at Cambridge, provided yet a third interpretation of Newton's thought.Very early in life Newton abandoned orthodox belief in the Trinity. At this time the Socinians were an important Arian sect amongst intellectual circles. It may be that Newton fell under Socinian influences, but I think not. He was rather a Judaic monotheist of the school of Maimonides. He arrived at this conclusion, not on so-to-speak rational or skeptical grounds, but entirely on the interpretation of ancient authority. He was persuaded that the revealed documents give no support to the Trinitarian doctrines which were due to late falsifications. The revealed God was one God.6Among contemporary scholars, the consensus is that Newton was an Arian rather than a Socinian.7 This view is clearly expressed by Richard [End Page 58] Westfall who writes, "Well before 1675, Newton had become an Arian in the original sense of the term. He recognized Christ as a divine mediator between God and man, who was subordinate to the Father who created him."8 Yet Frank Manuel, in his The Religion of Isaac Newton (1974), advises that we not try to push Newton into a theological categorization too quickly. He reminds us that Newton was, if nothing else, an original thinker.It is an error to seize upon his antitrinitrianism in order to pigeonhole him in one of the recognized categories of heresy—Arian, Socinian, Unitarian, or Deist.9So how did Isaac Newton conceive of the trinity? In exploring his writing on the subject we will be guided by two principles mentioned above. The first is Brewster's insight that the trinitarian doctrine has in fact been understood with a certain degree of variety within the sphere of orthodoxy. The Cognitive Reflection Test (CRT) is a measure of analytical reasoning that cues an intuitive but incorrect response that must be rejected for successful performance to be attained. The CRT yields two types of errors: Intuitive errors, which are attributed to Type 1 processes; and non-intuitive errors, which result from poor numeracy skills or deficient reasoning. Past research shows that participants who commit the highest numbers of errors on the CRT overestimate their performance the most, whereas those with the lowest (...) error-rates tend to slightly underestimate. This is an example of the Dunning-Kruger Effect (DKE). The present study examined how intuitive vs. non-intuitive errors contribute to overestimation in the CRT at different levels of performance. Female undergraduate students completed a seven-item CRT test and subsequently estimated their raw score. They also filled out the Faith in Intuition (FI) questionnaire, which is a dispositional measure of intuitive thinking. Data was separated into quartiles based on level of performance on the CRT. The results demonstrated the DKE. Additionally, intuitive and non-intuitive errors predicted miscalibration among low, but not high performers. However, intuitive errors were a stronger predictor of miscalibration. Finally, FI was positively correlated with CRT self-estimates and miscalibration, indicating that participants who perceived themselves to be more intuitive were worse at estimating their score. These results taken together suggest that participants who perform poorly in the CRT and also those who score higher in intuitive thinking disposition are more susceptible to the influences of heuristic-based cues, such as answer fluency, when judging their performance. It has generally been observed that cells grow to a certain size before they divide. In the last few years, the PI3K signal transduction pathway has emerged as one of the main signaling routes utilized by cells to control their increase in size. Here we focus on two components of this pathway, PKB and S6K, and briefly review the experiments that initially uncovered their roles in cell size control. In addition, we discuss a number of recent observations suggesting that the (...) generic models used to describe this pathway to date may have been oversimplified. Indeed, recent observations in Drosophila and mouse support a more complex interaction between these signaling components in development. Finally, we have utilized two contemporary studies involving PKB‐ and S6K‐deficient mice as a paradigm to underscore the importance of cell size and to accurately delineate the connections between signaling pathways for human disease, such as diabetes mellitus.
